Unless specifically permitted by law, gambling is prohibited in New Mexico pursuant to §60-2E-4 of the Gaming Control Act and the New Mexico Criminal Code, 30-19-1 thru 30-19-15 NMSA 1978. As you can see above, New Mexico’s minimum age requirement for tribal casinos is 21. The Pojoaque tribe tried forcing their way out of their state agreement in 2014, requesting that the casino age requirement be lowered to 18, alcohol be served on gaming floors, and the revenue-sharing model be dropped.
